Governance bodies according to L.D. No. 231/2001

Italian law provides for the criminal liability of legal entities, companies and associations in the event of criminal offences being committed for their benefit by their governing bodies.

The list of criminal offences that lead to liability is constantly being expanded and currently includes the following offences: unlawful receipt of public benefits, administrative undercutting, embezzlement, fraud to the detriment of the state, public corporations, bribery and extortion in office, falsification of designations and trademarks, crimes against trade and commerce, crimes in connection with company law, and much more.

We advise you in this context and, in close cooperation with our client, prepare the organisational model 231/2001 intended for the exemption from liability and also provide the necessary supervisory body, which also ensures the ongoing adaptation of the model.
